General Terms and Conditions

Scope
1.1 These General Terms and Conditions apply to all contracts between Astrid Neumann, [address], [email], [VAT ID if applicable] – hereinafter referred to as the “Photographer” – and her clients – hereinafter referred to as the “Clients” – regarding photographic services in the field of weddings, elopements, welcome events, rehearsal dinners, farewell brunches, couple shoots in connection with weddings, as well as related additional services.
1.2 These GTC apply insofar as the contracts are concluded with consumers within the meaning of Section 1 KSchG. Different conditions may apply to contracts with entrepreneurs.
1.3 The version valid at the time the contract is concluded shall apply. Individual written agreements in the offer or contract shall take precedence over these GTC.
1.4 Should individual provisions of these GTC be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
Conclusion of Contract and Reservation of Date
2.1 Offers made by the Photographer are non-binding unless expressly stated otherwise in writing.
2.2 A contract shall only come into existence when
a) the offer or contract has been confirmed in writing by the Clients, and
b) the agreed reservation fee has been received.
2.3 The wedding date shall only be reserved bindingly for the Clients upon receipt of the agreed reservation fee.
2.4 The Photographer is entitled to have the assignment carried out in whole or in part by qualified third parties, in particular second shooters or assistants.
Scope of Services
3.1 The specific scope of services shall be determined exclusively by the individually agreed offer or contract.
3.2 Unless expressly agreed otherwise in writing, the Photographer shall in particular owe
a) photographic coverage within the agreed time scope,
b) the selection of images deemed suitable from her professional point of view,
c) the professional editing of these selected images in her own style, and
d) the provision of the final image files in the agreed form.
3.3 Unless expressly agreed otherwise in writing, the following in particular shall not be owed
a) the delivery of all images taken,
b) the delivery of unedited files / RAW files,
c) the transfer of working files, catalogs, or presets,
d) a specific minimum number of images, unless expressly stipulated in the contract,
e) re-editing according to individual style specifications of the Clients outside the Photographer’s usual editing style.
3.4 The Photographer is free in the artistic and technical design. This applies in particular to visual language, perspective, selection of motifs, lighting, cropping, editing, and image selection.
3.5 The Clients acknowledge that wedding photography is a documentary and situation-dependent service. The Photographer therefore does not owe a result identical to reference images, Pinterest inspirations, or previous work.
Obligations of Cooperation of the Clients
4.1 The Clients shall provide the Photographer in due time with all information essential for the performance of the assignment. This includes in particular the schedule, addresses, contact persons, timing changes, photographic specifics, access restrictions, and any rules of the church, registry office, venue, or other service providers.
4.2 The Clients are responsible for ensuring that photography is permitted at all relevant locations and that any necessary permits are in place, unless these have expressly been assumed by the Photographer.
4.3 The Clients shall ensure that sufficient time slots are scheduled for group photos, couple portraits, and essential program items, insofar as such photographs are desired.
4.4 For full-day reportages of six hours or more, the Photographer and, where applicable, a second shooter shall be provided with appropriate catering in the form of a full meal and non-alcoholic beverages. The Photographer is entitled to integrate necessary short breaks into the schedule, provided that no essential program items are missed as a result.
4.5 Delays, restrictions, or reductions in performance resulting from insufficient cooperation by the Clients or third parties shall not be to the detriment of the Photographer.
Event Schedule, Guests, Motifs
5.1 The Photographer shall endeavor to document the course of the wedding comprehensively and with the greatest care. However, complete coverage of all guests, details, program items, or spontaneous moments cannot be guaranteed.
5.2 In particular, it cannot be guaranteed that every person present will be photographed individually or that every desired constellation will arise if this has not been actively organized or communicated.
5.3 Complaints based solely on missing individual motifs or photographs of certain persons or situations that were not taken shall not constitute a defect, provided that the Photographer has otherwise performed her services in accordance with the contract.
Image Selection, Editing, and Delivery
6.1 The selection of the images to be delivered shall be made exclusively by the Photographer.
6.2 The Clients shall receive only those images selected and edited by the Photographer. Unedited files, rejected images, test shots, duplicates, or images deemed technically or artistically unsuitable shall not be delivered.
6.3 Editing shall be carried out in the Photographer’s style. Subsequent requests for changes by the Clients shall only be possible by separate agreement and against additional remuneration.
6.4 Unless otherwise agreed, delivery shall be made digitally via a password-protected online gallery or by download link.
6.5 Stated delivery times are approximate, unless a binding delivery date has expressly been agreed in writing.
6.6 An early preview, sneak peek, or express delivery shall only be made if this has been expressly agreed.
Online Gallery and Data Storage
7.1 The Photographer shall make the final images available for a limited period via an online gallery or a download link. The specific period of availability shall depend on the respective agreement or the deadline communicated upon delivery.
7.2 The Clients are themselves responsible for downloading the delivered images in due time and securing them in at least two separate storage locations.
7.3 The Photographer shall keep the final edited images and, if available, the original data for an appropriate period of time. Permanent archiving is not owed.
7.4 After expiry of the retention period, the Photographer may delete files without further notice. Any later claim for restoration shall be excluded.
Copyright and Rights of Use
8.1 The copyright to all images shall remain with the Photographer.
8.2 Upon full payment of the agreed fee, the Clients shall receive a simple, non-exclusive, non-transferable right of use to the delivered images for private purposes.
8.3 Private use includes in particular
a) storage and reproduction for one’s own private use,
b) sharing with family members and guests in a private context,
c) publication on private social media profiles or private websites, provided that the images are not altered and the Photographer is credited, insofar as this is technically possible and reasonable on the respective platform.
8.4 Any commercial use requires the Photographer’s prior written consent. This applies in particular to
a) publications by other service providers,
b) use by venues, planners, florists, designers, magazines, or blogs,
c) paid advertisements, printed materials, PR, company websites, or editorial-commercial uses.
8.5 The Clients are not entitled to sell the images, license them for a fee, submit them to image databases, or grant third parties any broader rights of use.
8.6 Any editing of the images beyond customary cropping for private purposes is not permitted. In particular, filters, strong color changes, retouching by third parties, removal of watermarks, or any other interventions that alter the style are not permitted unless the Photographer has expressly agreed to this in writing.
Credit / Naming
9.1 In the case of any permitted publication of the images outside purely private use, the Photographer shall be credited as the author in an appropriate form.
9.2 For publications on the internet or on social media, the credit shall, where possible, be given as “Photo: Astrid Neumann” or by a clear link to the Photographer’s account or website.
9.3 When passing the images on to other service providers, the Clients shall inform them of the copyright requirements.
Remuneration and Terms of Payment
10.1 The fee agreed in the contract or offer shall apply.
10.2 Unless otherwise agreed in writing, a reservation fee of 50% of the agreed total fee shall be due upon booking. The remaining amount shall be due without deduction no later than the time specified in the contract, otherwise no later than 14 days before the wedding date.
10.3 The date shall only be reserved bindingly upon receipt of the reservation fee.
10.4 Additional services, in particular additional hours, additional events, travel or accommodation costs, after-wedding shoots, albums, prints, or special editing, shall be charged separately.
10.5 In the event of late payment, the statutory consequences of default shall apply. The Photographer is entitled to withhold delivery of images or products until full payment has been made.
Rescheduling and Cancellation by the Clients
11.1 As a specific wedding date is reserved exclusively upon booking and no other assignments are regularly accepted for that day, the reservation fee shall be deemed compensation for reserving the date and is non-refundable.
11.2 A rescheduling of the wedding date shall legally be deemed a cancellation of the originally agreed date and at the same time a request for a new date. The Photographer shall, where possible, check whether the new date is available. There shall be no entitlement to performance on the replacement date.
11.3 In the event of cancellation by the Clients, the following flat-rate cancellation fees are agreed:
a) up to and including 181 days before the date: the reservation fee already paid shall remain with the Photographer; no further payments shall be due;
b) 180 to 91 days before the date: 50% of the agreed total fee;
c) 90 to 31 days before the date: 75% of the agreed total fee;
d) from 30 days before the date: 100% of the agreed total fee.
11.4 Third-party costs and incidental costs already incurred that can no longer be cancelled or reversed shall be reimbursed in addition.
11.5 The Clients reserve the right to prove that the Photographer has suffered no damage or substantially less damage, insofar as this is required by law.
Cancellation or Failure by the Photographer
12.1 If the Photographer is unable to perform the assignment due to illness, accident, force majeure, or any other serious circumstance for which she is not responsible, she shall inform the Clients thereof without undue delay.
12.2 In this case, the Photographer shall use her best efforts to arrange a professionally suitable replacement photographer. However, there shall be no entitlement to the provision of a replacement person.
12.3 If no equivalent replacement can be found or if the Clients refuse a reasonable replacement, payments already made for services not yet rendered shall be refunded.
12.4 Further claims shall only exist in cases of intent or gross negligence, insofar as legally permissible.
Force Majeure and Circumstances Beyond Control
13.1 No liability shall be accepted for circumstances outside the Photographer’s sphere. These include in particular weather, traffic, traffic jams, road closures, official measures, pandemic-related restrictions, power outages, failures of venues or service providers, restrictions imposed by clergy or registry officials, house rules of venues, poor lighting conditions, or other unforeseeable events.
13.2 Such circumstances shall not entitle the Clients to a reduction of the fee, provided that the Photographer has essentially performed her services in accordance with the contract.
Liability
14.1 The Photographer shall be liable for damages only in cases of intent or gross negligence, insofar as no mandatory statutory provisions to the contrary apply vis-à-vis consumers.
14.2 The Photographer shall only be liable for the loss of image data in cases of intentional or grossly negligent conduct. Insofar as legally permissible, liability shall be limited to the agreed fee.
14.3 No liability shall exist for indirect damages, consequential damages, loss of profit, immaterial damages, or claims by third parties, insofar as legally permissible.
14.4 The Photographer shall not be liable for the quality or performance of services provided by third parties, even if she gives recommendations or arranges contacts.
14.5 No liability shall be accepted for technical disruptions of online galleries, platforms, or email delivery that are outside the Photographer’s sphere of influence.
Travel and Accommodation Costs
15.1 Unless otherwise agreed in the offer, travel, transport, parking, toll, accommodation, and other necessary expenses shall be remunerated separately.
15.2 If, in the Photographer’s assessment, the place of assignment requires arrival on the previous day or an overnight stay, in particular for organizational or scheduling reasons, appropriate accommodation shall be provided or reimbursed, insofar as this is provided for in the offer.
Albums, Prints, and Other Products
16.1 If albums, prints, or other physical products are ordered, their production shall only take place after full payment has been made.
16.2 Minor color deviations between screen display, online gallery, laboratory print, and album print shall not constitute a defect.
16.3 Proof approvals by the Clients shall be binding. The Photographer shall not be liable for errors that were not objected to after approval.
Data Protection
17.1 Personal data shall be processed in accordance with the Photographer’s privacy policy in its currently valid version.
17.2 The Clients acknowledge that for the purpose of contract performance, personal data may be processed and transmitted to technical service providers, gallery services, payment service providers, print service providers, or other processors, insofar as this is necessary for the performance of the contract.
17.3 Further information is set out in the separate privacy policy.
Use of the Images by the Photographer
18.1 The Photographer is entitled to use the images created within the scope of the assignment for self-promotion and for the presentation of her work. This includes in particular publication on the website, blog, social media, in portfolios, in submissions to professional publications, printed products, exhibitions, as well as in other advertising and editorial contexts connected with the Photographer’s activity.
18.2 This authorization shall apply unless the Clients expressly make a different written agreement with the Photographer. Such a restriction may apply in particular to images in which persons are recognizably depicted.
18.3 If the Clients wish that certain images, categories of images, or photographs containing recognizable persons are not to be published, this must be communicated to the Photographer in writing. If no separate notification is made, the use pursuant to Clause 18.1 shall be deemed agreed.
18.4 In selecting the images to be used for self-promotion, the Photographer shall take into account the legitimate interests of the persons depicted and shall not publish any images that could unreasonably impair privacy, intimacy, or other worthy interests of protection.
18.5 Insofar as, in addition to the Clients, other persons are recognizably depicted in images, publication by the Photographer shall only take place within the legally permissible scope.
Right of Withdrawal for Consumers in Distance Contracts
19.1 Insofar as a statutory right of withdrawal exists under the Distance and Off-Premises Contracts Act, the Clients shall be informed thereof separately and in due time before the contract is concluded.
19.2 The statutory notice of cancellation or withdrawal as well as a model withdrawal form shall be provided to the Clients on a durable medium, insofar as this is legally required.
19.3 If the Clients expressly request that the Photographer begin performance before expiry of the withdrawal period, a proportionate amount for services already rendered may be payable in the event of a later withdrawal, insofar as the statutory requirements for this are met.
Final Provisions
20.1 Austrian law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
20.2 The statutory places of jurisdiction shall apply to disputes with consumers.
20.3 The contract language is English.
